StrikeGold Contribution Terms

By uploading content to StrikeGold and checking the consent box, you (“you” or “Contributor”) agree to these terms with StageStrike, a brand of BYCAS MEDIA LLC (“StageStrike,” “we,” “us”).
1. Your content and your representations
By contributing, you represent and warrant that:
- The content is your own original work, or you otherwise hold all rights necessary to grant the license below.
- You have obtained all necessary permissions, consents, and releases from every identifiable person appearing in the content, including parental or guardian consent for any minor.
- For any minor depicted in the content, you are the parent or legal guardian of that minor, or you have obtained the express permission of their parent or legal guardian. You understand the content may be used commercially — including on our website, in advertising, in retail listings (such as B&H), and on product packaging.
- The content does not infringe anyone’s copyright, trademark, privacy, publicity, or other rights, and contains no confidential or embargoed material you are not permitted to share.
2. The rights you grant us
You grant StageStrike an irrevocable, perpetual, worldwide, royalty-free, fully paid-up, transferable, sublicensable, non-exclusive license to use, reproduce, modify, adapt, create derivative works from, publish, distribute, display, perform, and otherwise exploit the content in any media now known or later developed, for any purpose including marketing and product purposes.
This license includes the right to use the name, voice, image, and likeness of any person appearing in the content (including you) in connection with those uses.
To the fullest extent permitted by law, you waive any moral rights — including rights of attribution and integrity — in the content.
This license is perpetual and irrevocable, and it survives the end of your participation in StrikeGold and the deletion of your account.
3. Credit / attribution
We never show your name unless you ask us to. When you upload, you can choose to be credited — by the name or handle on your account — wherever your content appears. If you don’t choose credit, we use your content without your name. Your choice about credit does not change the license in Section 2; it only controls whether your name is shown, and you can change your preference for future submissions at any time.
4. Strikes are promotional loyalty points, not money
- Approved contributions earn Strikes under the current StrikeGold program rules, which we may change.
- Strikes are promotional loyalty points with no cash value, and do not constitute money, property, wages, compensation, or stored value. They are not payment for your content and are not transferable except as the program allows.
- StageStrike may, in its sole discretion, permit users to redeem or exchange Strikes for certain promotional benefits — including discounts toward StageStrike products and Credits for use within StageStrike applications. Any such redemption or exchange is governed by the then-current program rules (and, for Credits, the applicable StageStrike Credits terms) and may be modified, suspended, or discontinued at any time. Earning Strikes today does not guarantee any specific future redemption value, rate, or availability.
- We may decline, remove, or reverse Strikes for content that violates these terms or appears to game the system.
5. We’re not obligated to use your content
Submitting content, and earning Strikes for it, does not require us to publish or use it anywhere. Approval for Strikes and actual use in a campaign are separate decisions.
6. Removing your content
If you want content removed, contact us at info@stagestrike.com. We will cease new uses within a commercially reasonable period, but we have no obligation to remove or recall content already incorporated into printed materials, packaging, advertisements, social media posts, partner or retail listings, press releases, or archived materials. This does not limit the license in Section 2.
7. What you may not upload
No content that: infringes third-party rights; depicts unlawful activity; is defamatory, harassing, hateful, or sexually explicit; reveals others’ private information without permission; or contains malware. We may reject or remove anything at our discretion.
8. Eligibility
You must be at least 18 years old (or the age of majority where you live) to contribute. The StrikeGold platform is not intended for and may not be used by children under 13. Requirements for minors who appear in content are set out in Section 1.
9. Indemnification
You agree to defend, indemnify, and hold harmless BYCAS MEDIA LLC, StageStrike, and their officers, employees, and affiliates from any claims, damages, liabilities, losses, costs, and attorney’s fees arising out of: (a) your breach of these terms; (b) any infringement claim relating to your content; or (c) your failure to obtain any necessary permissions or releases.
10. Privacy
To run StrikeGold we store your account identity (through your Shopify customer account), your submissions, and submission metadata — including your consent and attribution choices and the time you made them. The platform is not intended for children under 13, and we reserve the right to remove any content we believe was submitted by, or that improperly depicts, a minor. 11. Changes to these terms
We may update these terms. Material changes will be published with a new version number, and acceptance is captured per submission, so the version you agreed to is the one that governs that submission.
12. Governing law, venue, and dispute resolution
These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.
Any dispute arising out of or relating to these terms or the content will be resolved by binding arbitration on an individual basis. You and StageStrike waive any right to a jury trial and any right to participate in a class action or class-wide arbitration.
For any claim not subject to arbitration, to compel or enforce arbitration, or to seek injunctive relief, the exclusive venue shall be the state and federal courts located in Orange County, Florida.
In any dispute, the prevailing party is entitled to recover its reasonable attorney’s fees and costs.
